Atlanta Firm Snares $1.5 Million Malpractice Victory
When the jury ruled in Gibbs' favor on Nov. 5, awarding the 34-year-old housewife, and her husband a $1.5 million verdict against Kaiser Foundation Health Plan of Georgia, Inc., in connection with the stillborn birth of their son. The verdict followed eight days of trial and five hours of deliberation.

The Jury found Kaiser Permanente guilty of medical negligence in managing the treatment of meningococcemia which led to the amputation of both his hands and his feet because of gangrene.  In it's early states, meningococcemia is certainly manageable and, when it is treated properly, gangrene can be prevented.  However, the jry decided that Kaiser's inflexible attitude of staying with its own restrictive treatment policies and procedures, and allowing a deviation from these policies only after a long battle by the plaintiff with the company's bureaucracy, was sufficient reason to award the boy $45.5 million on the grounds of medical negligence. - Source - "Managing Care - A Shared Responsibility"  The Concept of Managed Care and Its Practical Implications, pg 35 - By Joseph L.
